Der Tod des Arbeitnehmers beendet das Arbeitsverhältnis, da der Arbeitnehmer seiner persönlichen Leistungsverpflichtung gem. § 613 Satz 1 BGB nicht mehr nachkommen kann. Schon entstandene, aber noch nicht erfüllte Ansprüche gegen den Arbeitgeber aus dem Arbeitsverhältnis gehen auf die Erben über. Hierbei kann es sich um Lohn- und Gehaltsansprüche handeln, ebenso aber auch um entstandene Abfindungsansprüche oder bereits entstandene Schadenersatzansprüche. Nach dem Tod des Arbeitnehmers wandelt sich der nicht mehr verwirklichbare Urlaubsanspruch nach § 7 Abs. 4 BUrlG in einen Abgeltungsanspruch um, der ebenso den Erben zusteht.Der Tod des Arbeitgebers beendet das Arbeitsverhältnis nicht, dieses geht auf dessen Rechtsnachfolger (Erben) über, auch wenn diese den Betrieb nicht weiter führen.
