Kommt der Arbeitgeber seinen Verpflichtungen aus dem Betriebsverfassungsgesetz nicht nach, insbesondere unterläuft er die gesetzlichen Mitbestimmungsrechte, steht dem Betriebsrat die Einleitung eines Beschlussverfahrens vor dem zuständigen Arbeitsgericht zu.

Weitere gerichtliche Auseinandersetzungen (kollektives Arbeitsrecht) sind beispielsweise das

• Beschlussverfahren nach § 23 Abs. 3 BetrVG , wenn der Arbeitgeber in grober Weise gegen seine Pflichten aus dem Betriebsverfassungsgesetz (BetrVG) verstößt, Einleitung durch den Betriebsrat.
• Weitere Beschlussverfahren nach § 2a BetrVG

Weiterhin sind die Arbeitsgerichte zuständig für Streitigkeiten aus einem Arbeitskampf (Streik, Aussperrung) und in Verfahren der Tarifvertragsparteien (Arbeitgeberverbänden, Gewerkschaften) aus dem Abschluss von Tarifverträgen sowie damit im Zusammenhang stehende Streitgegenstände. Über diese Verfahren entscheidet das Arbeitsgericht gleichermaßen im Wege des Beschlussverfahrens.
